What to know before registering an LLC

On Behalf of | Apr 5, 2024 | business law |

When starting a business in Illinois, one can benefit from understanding the initial process to have the business registered within the state. Many people choose to start an LLC because the steps required are simple and easy to understand. Most small business owners appreciate the protections provided by an LLC and choose this business structure due to its simplicity in formation and operation.

Registering an LLC

Each LLC must have a unique name that is not shared by other LLCs in the state. Before registering the name of a new LLC, one can search the state’s database to ensure the name is not being used. Choosing a unique name sets one’s business apart from the competition and prevents confusion among customers or clients searching for a specific LLC. Once an available name is chosen, one can register the name and include the LLC designation at the end of the business name.

Every LLC must appoint an agent and register their name with the state. The agent has the authority to act on behalf of the LLC when dealing with the Secretary of State and other important matters. The business must have a registered office in the state with a street or road address. Filing fees are required during the registration process.

Legal advice when starting an LLC

Starting a business in Illinois comes with many challenges, some of which are legal considerations that must be adhered to.
