The assistance we provide to our clients in this area typically involves Chapter 7 and Chapter 13 bankruptcy.

Advocates for Creditors' Rights

Just as debtors have rights under the law, creditors too need legal representation to recover debts owed to them. Our attorneys are zealous advocates for creditors in bankruptcy matters and ensure protection of their rights in all proceedings. Bankruptcy represents a business loss for a creditor and we work hard to minimize that loss.

We can assist creditors with filing claims, objecting to discharge and plan confirmation, pursuing adversary matters and contested actions and filing reaffirmation agreements.

Representing Debtors in Filing for Chapter 7 or Chapter 13 Bankruptcy

Excessive and unmanageable debt can cause a great amount of stress in your personal and professional life. Fortunately, a solution to this problem may be found in the form of filing for bankruptcy. At Farrell, Hamilton & Julian, P.C, our attorneys will take the time to examine your situation and help you determine whether filing for bankruptcy is appropriate under the circumstances. Please note that contrary to popular belief, bankruptcy is still a viable option for many clients despite the recent amendments to the federal bankruptcy laws.

We can assist clients with filing for the following forms of bankruptcy:

  • Under Chapter 7 bankruptcy, otherwise known as liquidation bankruptcy, the debtor's non-exempt assets may be sold to cover the debt. Generally, the debtor is able to keep his or her home, car and other necessary household items. Under the bankruptcy laws, those filing for Chapter 7 bankruptcy must meet certain requirements and attend credit counseling sessions from an approved agency.
  • Under Chapter 13 bankruptcy, otherwise known as reorganization bankruptcy, a qualified debtor presents a repayment plan to the court. If approved, the plan allows the debtor to pay off a reduced amount of the total debt over a 3 to 5 year period using disposable income (income not needed for ordinary living expenses). The debtor may keep his or her home, car and other necessary household items.
  • Businesses may file for both liquidation and reorganization bankruptcy, but the latter is filed under Chapter 11, not Chapter 13.

No matter the situation, we will guide you through the process, attend all hearings and file all of the necessary documentation.
