Please note that contrary to popular belief, bankruptcy is still a viable option for many clients despite the recent amendments to the federal bankruptcy laws.

We can assist clients with filing for the following forms of bankruptcy:

• Under Chapter 7 bankruptcy, otherwise known as liquidation bankruptcy, the debtor’s non-exempt assets may be sold to cover the debt. Generally, the debtor is able to keep his or her home, car and other necessary household items. Under the new federal bankruptcy laws, those filing for Chapter 7 bankruptcy must meet certain requirements and attend credit counseling sessions from an approved agency.
• Under Chapter 13 bankruptcy, otherwise known as reorganization bankruptcy, a qualified debtor presents a repayment plan to the court. If approved, the plan allows the debtor to pay off a reduced amount of the total debt over a 3 to 5 year period using “non-disposable” income (income not needed for ordinary living expenses). The debtor may keep his or her home, car and other necessary household items.
• Business may file for both liquidation and reorganization bankruptcy, but the latter is filed under Chapter 11, not Chapter 13.
